Terms of Service

These Terms of Service ("Terms") govern your use of BIM Monkey (the "Service"), operated by BIM Monkey Incorporated, a Delaware corporation ("BIM Monkey," "we," "us," or "our"). By signing up for or using the Service, you ("you" or "Customer") agree to these Terms. If you are entering into these Terms on behalf of a firm or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. What the service does

BIM Monkey connects to your Revit model via Banana Chat — an AI assistant powered by Anthropic Claude models running directly inside the Revit plugin — and generates construction document sets (sheets, views, details, and annotations) using AI tuned to your firm's architectural drawings.

2. What we store

When you upload a PDF drawing set, your browser renders each page to a PNG image before sending it to BIM Monkey's servers. The original PDF binary is never transmitted to or stored on BIM Monkey's servers. What we do store:

  • Page image renders — a PNG render of each uploaded page, stored per page in your firm's private library. These power the sheet thumbnails visible in the web dashboard.
  • AI analysis per page — structured data extracted from each page (sheet type, detail types, material callouts, annotations, layer assemblies, dimensions, and cross-references), stored as retrievable examples to personalize AI generation output to your firm's standards.
  • Revit model data — a structured summary of your Revit model (room names, levels, wall types, view list) submitted during each generation run and stored alongside the generation record.
  • Session corrections — corrections and preferences you give Banana Chat during generation sessions, stored in your firm's account on BIM Monkey's servers as firm memory and project notes, and used to personalize future generation runs for your firm.
  • Workflow signals — the WorkflowObserver component of the Revit plugin collects architectural workflow events during your sessions: which views you activated, how long you spent in each view, what categories of model elements were modified, and session start and end times. These events are uploaded to BIM Monkey's servers at session end and used exclusively to synthesize firm-wide working standards for your account.
  • Correction classifications — when you save a correction in Banana Chat, the text of that correction is sent to an AI model (Claude Haiku via Anthropic's API) to classify it as a permanent workflow rule or a plugin-version-specific workaround. This classification call is subject to Anthropic's data retention policy.

Your drawing data is stored in your firm's private library and is never used to train other users' accounts or shared with other firms.

When you use the Parcel Data, Permit History, Site Climate, or EPD search tools in the Revit ribbon, the address or keyword query you enter is sent to BIM Monkey's servers and forwarded to third-party data providers to fulfill the request. These queries are logged for reliability monitoring but are not retained as part of your drawing library.

Page image data sent to the AI for analysis passes through Anthropic's API and is subject to Anthropic's data retention policy. Generation sessions invoke the Claude API directly from your machine to Anthropic's API endpoints; data submitted during such sessions also flows to Anthropic and is subject to their terms.

By using the Service, you grant BIM Monkey the right to:

  • Store and retrieve your firm's library data to power your generations.
  • Use aggregated, non-identifiable usage metrics (sheets generated, features used, error rates) to improve the platform.
  • Use system logs for debugging, reliability monitoring, and service improvements.

BIM Monkey may access stored generation plans and Revit model inputs internally for the purpose of improving the platform's reliability and developing new features — not to personalize or improve AI output for any other firm. This data is never shared externally.

We do not use your firm's drawing content to train shared AI models or to improve output for any other firm.

3. What we don't do

  • We do not sell your data to third parties.
  • We do not share your firm's training data or drawing library with other firms. Your project data is never used to train other users' accounts.
  • We do not claim ownership of your architectural work. Your designs remain yours.

4. Your right to delete

You may archive or delete individual projects from your library at any time directly from the app.bimmonkey.ai dashboard. Archiving a project immediately excludes it from all AI generation and moves it to a recovery archive. Archived projects are permanently deleted from BIM Monkey's servers after 30 days. You may restore an archived project or permanently delete it at any time before the 30-day window expires.

To delete your entire firm account and all associated data, email us at [email protected]. We will remove your private library within 30 days.

5. Claude API costs

During installation, the BIM Monkey installer saves your Anthropic API key to a local configuration file on your machine. BIM Monkey does not transmit or store your Anthropic API key on its servers.

BIM Monkey covers the cost of AI analysis when you upload drawings to your library — that processing runs on BIM Monkey's Anthropic account, not yours. Generation sessions are different: each session uses Banana Chat — BIM Monkey's in-Revit AI assistant — on your machine, consuming Claude API tokens billed directly to your Anthropic account, not to BIM Monkey. Typical sessions cost $0.75–$1.50 per session depending on project size and the length of the generation conversation. Redline analysis is billed the same way. You are responsible for any Claude API charges incurred through your use of the Service.

6. Pricing, refunds, and cancellation

BIM Monkey is offered on an annual plan ($1,500/year, billed once per year) or a monthly plan ($175/month, billed monthly). We may change pricing with 30 days' written notice.

Customers who pay a $500 early access deposit receive a credit of $500 applied to their Year 2 annual subscription invoice. The deposit does not reduce the Year 1 subscription price.

You may cancel your subscription at any time from the billing section of your account settings. Cancellation takes effect at the end of the current billing period — you retain access through that date. Annual plan subscribers may cancel within 30 days of purchase for a full refund. We do not prorate or refund partial periods outside of that window.

Annual plan subscribers may request a full refund within 30 days of their subscription purchase date. To request a refund, email [email protected] with your account email and the reason for your request. We will process eligible refunds within 5–10 business days. Monthly subscriptions are not eligible for refunds. Early access deposits are non-refundable.

If you believe you have been charged in error, contact us at [email protected]. We will respond within 5 business days. If we cannot resolve a dispute directly, you may contact your card issuer to initiate a chargeback in accordance with their policies.

7. Acceptable use

You may use the Service for legitimate architectural practice. You may not use it to generate content that infringes third-party intellectual property, violates building codes without disclosure, or is otherwise unlawful.

Content you upload must be limited to architecture, engineering, and design. This includes Revit models, construction drawing PDFs, redlines, specifications, and similar professional project documentation. Uploading content unrelated to AEC practice — including personal files, proprietary data belonging to another firm, or any material that is illegal, defamatory, or sexually explicit — is prohibited and may result in immediate account termination.

BIM Monkey is not responsible for user-uploaded content and does not pre-screen uploads. We reserve the right to remove any content that, in our reasonable judgment, violates these Terms, applicable law, or is otherwise harmful or inappropriate. If you believe content on the platform violates these Terms, contact us at [email protected]. We will investigate and remove violating content within a reasonable time.

Accounts must be registered with a professional email address matching your firm's domain. Registering with a personal email address in order to gain access to another firm's private training library is a violation of these Terms and may result in immediate account termination.

All output generated by the Service must be reviewed and approved by a licensed design professional before submission for permitting, construction, or any regulated use. BIM Monkey is an assistive tool for licensed practitioners — it is not a substitute for the professional judgment, review, and oversight required by applicable licensing laws and codes of professional conduct. The licensed professional initiating each session is the sole determiner of whether and how to use AI-generated output. BIM Monkey does not warrant that generated documents are accurate, complete, or code-compliant, and is not liable for decisions made on the basis of unreviewed AI output.

8. Intellectual property and license restrictions

BIM Monkey grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your firm's internal professional practice. No other rights are granted.

You may not:

  • Reverse engineer or decompile any part of the Service, including the Revit plugin, AI models, or web platform. This includes disassembling, deobfuscating, or otherwise attempting to derive source code or trade secrets.
  • Reproduce or redistribute the Service or any substantial portion of it, including reselling access, white-labeling the platform, or bundling it into a competing product — except that authorized partners may embed BIM Monkey generation capabilities pursuant to a written Partner API Agreement with BIM Monkey.
  • Scrape or extract data from the dashboard or API beyond what is produced in the normal course of your own projects — automated harvesting of generated drawings, training data, or platform outputs for use outside the Service is prohibited.
  • Circumvent access controls, including bypassing authentication, the trial paywall, or any technical measure we use to restrict unauthorized access.
  • Sublicense or transfer your account or any rights under these Terms to another party without our written consent.

The Revit plugin includes an encrypted knowledge base — comprising Revit API guidance, code compliance references, annotation standards, and architectural best practices — that is proprietary licensed content owned exclusively by BIM Monkey. This content is delivered encrypted to your machine and decrypted in memory using credentials tied to your active subscription. Access to the knowledge base is contingent on a valid subscription; it is not licensed for offline use, extraction, or use outside the Service. Attempting to decrypt, copy, or redistribute this content is a violation of these Terms and applicable intellectual property law.

BIM Monkey owns all right, title, and interest in the platform, the Revit plugin, the base AI models, the training infrastructure, and all associated trademarks and branding. Your use of the Service does not transfer any of these rights to you. Your architectural work and the documents you produce remain yours.

9. Logo and name license

Customer grants BIM Monkey a non-exclusive, royalty-free, worldwide license to use Customer's name, logo, and any testimonials or feedback Customer provides to identify Customer as a customer and to promote the Service on BIM Monkey's website, in marketing materials, in investor and pitch materials, and in other communications. Customer may revoke this license at any time by written notice to [email protected]. BIM Monkey will remove Customer's name and logo from then-active channels within 30 days of revocation; materials already distributed (printed decks, archived content, prior investor communications) are not subject to recall.

10. Professional responsibility

The architect of record, engineer of record, or other licensed professional using the Service retains full professional, legal, and ethical responsibility for all documents produced with BIM Monkey's assistance. This includes responsibility for:

  • The accuracy, completeness, and code compliance of all generated documents.
  • Reviewing and approving all AI-generated output before it is stamped, signed, or submitted.
  • Ensuring use of the Service is consistent with the requirements of applicable state licensing boards and professional codes of conduct, including the AIA Code of Ethics.
  • Maintaining the accountability chain required under their license — AI assistance does not transfer or diminish professional liability.

BIM Monkey generates documents under the direction of the licensed professional who initiates and oversees each session. The professional's judgment, input, and approval are integral to every document produced.

11. Export controls and sanctions

The Service is provided from the United States and is subject to United States export control laws and economic sanctions, including the Export Administration Regulations (EAR) administered by the U.S. Department of Commerce and sanctions programs administered by the U.S. Department of the Treasury, Office of Foreign Assets Control (OFAC).

By using the Service, you represent and warrant that:

  • You are not located in, organized under the laws of, ordinarily resident in, or accessing the Service from any jurisdiction subject to comprehensive U.S. sanctions, which currently include Cuba, Iran, North Korea, Syria, the Russian Federation, Belarus, and the Crimea, Donetsk, Luhansk, Kherson, and Zaporizhzhia regions of Ukraine, and any other jurisdiction designated as sanctioned by the U.S. Government from time to time;
  • You are not identified on any U.S. Government restricted-party list, including the OFAC Specially Designated Nationals and Blocked Persons List, the Commerce Department's Entity List or Denied Persons List, or any equivalent list maintained by the U.S. or any other applicable government;
  • You are not owned or controlled by, and are not acting on behalf of, any person or entity described in the preceding bullets;
  • You will not use the Service to provide services, data, or output to any person or entity described in the preceding bullets;
  • You will not use the Service in violation of any applicable export control or sanctions law, including by using or facilitating use of the Service for the development, design, manufacture, or production of nuclear, chemical, or biological weapons, or missile technology;
  • You will obtain all licenses, permits, and authorizations required by applicable export control or sanctions law in connection with your use of the Service.

The Service depends on third-party infrastructure, including the Anthropic Claude API, that is independently subject to export controls and sanctions and may be unavailable in some jurisdictions. BIM Monkey makes no representation that the Service is available or will function in any particular jurisdiction.

If you become aware that your use of the Service is or may become inconsistent with the representations in this Section, you will immediately stop using the Service and notify us at [email protected]. We may suspend or terminate your access to the Service at any time, with or without notice, if we have reason to believe your use is inconsistent with this Section or with applicable law.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, BIM MONKEY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, BIM Monkey does not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) AI-generated output will be accurate, complete, code-compliant, or suitable for any particular project; or (d) the Service or any third-party service it depends on, including the Anthropic Claude API, will be available in any particular jurisdiction or at any particular time.

AI-generated construction documents require professional review before use in permitting, construction, or any regulated context. BIM Monkey is a tool to assist licensed architects and engineers, not a replacement for professional judgment.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BIM MONKEY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT BIM MONKEY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BIM MONKEY'S TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO BIM MONKEY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

The limitations in this Section apply notwithstanding the failure of any limited remedy of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, BIM Monkey's liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless BIM Monkey, its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your violation of any applicable law or regulation, including export control or sanctions law; (c) your violation of any third party's rights, including intellectual property or privacy rights; (d) any content you upload to the Service; or (e) any decision to use, rely on, or submit AI-generated output for permitting, construction, or any regulated purpose without proper professional review.

15. Force majeure

Neither party shall be liable for any failure or delay in performance under these Terms (other than payment obligations) caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, internet or utility outages, third-party service failures (including failures of the Anthropic Claude API or other upstream providers), or pandemic-related restrictions.

16. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of such courts. Each party waives any right to a jury trial.

17. Miscellaneous

These Terms, together with any other written agreement between you and BIM Monkey, constitute the entire agreement between the parties regarding the Service. If any provision of these Terms is found unenforceable, the remainder will remain in full effect. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our written consent; we may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets. The headings in these Terms are for convenience only and have no legal effect.

18. Partner API

BIM Monkey provides a Partner API that allows authorized third-party AEC platforms ("Partners") to submit building model data as JSON and receive AI-generated construction document plans in return. Partner access is granted via partner API keys issued under a separate written Partner API Agreement.

When a Partner calls the Partner API:

  • The model data JSON submitted by the Partner is stored on BIM Monkey's servers as a generation record, subject to the same retention and deletion terms as Section 4.
  • The generation runs against the firm account linked to the partner key, using that firm's training library and standards. No data from one Partner's calls is used to personalize output for another Partner.
  • The AI generation cost for Partner API calls is billed to BIM Monkey's Anthropic account, not to the Partner's.
  • Partners are responsible for ensuring that all output generated via the Partner API is reviewed and approved by a licensed design professional before use in permitting, construction, or any regulated context, as required by Section 10. Partners must communicate this requirement to their end users.
  • BIM Monkey may suspend or revoke a partner key at any time, with or without notice, if the Partner's use violates these Terms, the Partner API Agreement, or applicable law.

19. Data isolation

Your project data is never used to train other users' accounts. Each firm's drawing library, approved examples, and generation history are strictly isolated to that firm's account. BIM Monkey does not operate a cross-firm training pool, community library, or any program that shares one firm's data with another.

20. Changes to these terms

We may update these Terms. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
